Terms of Service

1. About Geko
Geko is a marketplace platform that connects customers with independent restaurants. We are a technology platform operator, not a restaurant or food seller. Restaurants on our platform are independent vendors responsible for their own food preparation, quality, and compliance with health regulations.
2. Your Account
To use Geko, you must:
- Be at least 18 years of age
- Provide accurate and complete information
- Maintain only one account per person
- Not share your account credentials with others
- Be responsible for all activities under your account
We reserve the right to suspend or terminate accounts that violate these requirements or engage in fraudulent activity.
3. Placing Orders
When you place an order through Geko:
- You are requesting services from an independent restaurant
- Your order is subject to the restaurant's acceptance
- The restaurant may refuse or cancel orders at their discretion
- Menu items, prices, and availability are subject to change
- Minimum order amounts apply (if specified by the restaurant)
4. Payments
Payment for your order is processed securely by Stripe. By placing an order, you authorize us to charge your payment method for the full order amount, including:
- Food items and restaurant charges
- Delivery fees
- Service fees
- Applicable taxes
We do not store your credit card details. All payment information is handled by Stripe in accordance with PCI-DSS standards.
5. Delivery
Delivery is handled by independent drivers coordinated through Onfleet. Please note:
- Estimated delivery times are provided for convenience only and are not guaranteed
- Delivery times may vary due to traffic, weather, or distance
- You must provide accurate delivery instructions and contact information
- Drivers are independent contractors, not employees of Geko
6. Cancellation and Changes
Before Restaurant Acceptance: You may cancel your order without penalty if the restaurant has not yet accepted it.
After Restaurant Acceptance: Once a restaurant has accepted your order, you cannot cancel it. The order will proceed to preparation and delivery. Cancellation requests after acceptance may result in charges.
7. Liability Limitation
Geko is not responsible for:
- Food Quality: The quality, preparation, or safety of food provided by restaurants
- Restaurant Delays: Delays in order preparation by restaurants
- Delivery Issues: Delivery delays, lost orders, or driver conduct beyond our reasonable control
- Allergies or Dietary Issues: We are not liable for allergic reactions or dietary concerns resulting from orders
- Third-Party Services: Services provided by restaurants, drivers, payment processors, or other third parties
These limitations apply to the fullest extent permitted by law.
8. Prohibited Activities
You agree not to:
- Use Geko for illegal purposes
- Provide false or misleading information
- Harass, threaten, or discriminate against others
- Attempt to gain unauthorized access to our systems
- Place false or fraudulent orders
- Manipulate prices or exploit platform features
Violation of these terms may result in account suspension or termination.
9. Intellectual Property
All content on the Geko platform, including logos, text, graphics, and software, is the property of Geko or its licensors. You may not reproduce, distribute, or modify any content without permission.
10. Governing Law
These Terms of Service are governed by the laws of the Kingdom of Thailand. Any disputes arising from your use of Geko will be resolved in accordance with Thai law.
11. Modification of Terms
We may update these Terms of Service from time to time. The updated terms will be effective upon posting. Your continued use of Geko after changes constitute your acceptance of the updated terms.
